Planning Framework

Leichhardt Town Plan 

The  Leichhardt Town Plan Guide - 108 KB outlines controls and guidelines for all development within the Leichhardt Local Government Area (LGA). The Town Plan has been developed over several years and with significant community input. It is a statutory document and has been developed in accordance with the provisions of the Environmental Planning and Assessment Act 1979.

The Town Plan is a package of planning documents but it essentially comprises two main documents; the Leichhardt Local Environmental Plan 2000 and the Leichhardt Development Control Plan 2000. Together, these two documents form the Council’s forward plan for the whole of the LGA.

Other Development Controls

Apart from the Leichhardt Town Plan, there is a range of other development controls that affect property within the Leichhardt Local Government Area. These may be in the form of State Government controls or other Development Control Plans or policies of the Council.

Development Control Plans

In addition to DCP 2000, Council has several other Development Control Plans that may apply to your property. These range from specific DCP’s that relate to individual properties in the Leichhardt Local Government Area, to Plans that outline overall controls for specific types of development. Contributions Plans

Section 94 of the Environmental Planning and Assessment Act 1979 permits Council to levy or require provision of facilities or land where, as a consequence of development, the increased number of residents or workers will result in an increased demand for those services. State Government Controls

The State Government has a range of controls that may affect development within the Leichhardt Local Government Area. Such controls are in the form of Regional Environmental Plans (REP’s) or State Environmental Planning Policies (SEPP’s). In addition, the Minister can issue Directions and policy guidelines that are published on occasion.

Within the Leichhardt Local Government Area, there are several Regional Environmental Plans that affect significant portions of the Council area. Such REP’s may overlay additional controls that need to be considered in addition to those contained within the Leichhardt Town Plan, while others may place full development control in the hands of the State Government. State Environmental Planning Policies also apply to the Leichhardt LGA and have a varying level of impact depending on that particular document. Such SEPP’s may control the development of specific areas or sites, such as harbour front land, or they may apply to a specific type of development, such as boarding houses.
